1. Parties
This Agreement is concluded between the contractor providing services under the Epsilos brand ("Epsilos") and the individual or legal entity that downloads, installs or uses the Free Edition of the Epsilos software ("User"), when the User accepts the Agreement electronically during download or installation.
2. Definitions
- Software: The Epsilos website and e-commerce platform, including the admin panel, modules, themes and updates.
- Free Edition: The edition of the Software offered free of charge, with a scope set by Epsilos.
- Licence: The right of use granted to the User for one Domain and verified by the Software.
- Domain: The internet domain the Licence is issued for and the Software runs on.
- Epsilos Credit: The "Created by Epsilos" notice and link that the Software automatically shows at the very bottom of every page of a site running the Free Edition.
- Branding Removal Right: The paid right that stops the Epsilos Credit from being shown.
3. Scope of the Licence
3.1. Epsilos grants the User a free, non-exclusive, non-transferable, non-sublicensable right to use the Free Edition of the Software on a single Domain.
3.2. The features included in the Free Edition are set by Epsilos and may be changed with prior notice. Paid features, packages, themes and add-ons are purchased separately.
3.3. The Licence is verified online by the Software. The User agrees not to interfere with this check.
3.4. The domain and the hosting service the Software needs are provided by the User at the User's own cost. The User may also buy hosting from Epsilos with one of the Epsilos Hosting plans; that service is then governed by the chosen plan's terms and the Terms of Sale.
4. Intellectual Property
4.1. All intellectual property rights in the Software's source and compiled code, designs, themes, logos and the "Epsilos" brand belong to Epsilos. This Agreement only grants the right of use in Section 3 and does not transfer any ownership.
4.2. Content the User uploads to the site, such as text, images, products and customer data, belongs to the User, who is responsible for its lawfulness.
5. Epsilos Credit (Attribution Requirement)
5.1. The Free Edition is provided free of charge in return for the Epsilos Credit being visibly shown on the site. Unless the User has acquired the Branding Removal Right, the User agrees, regarding the Epsilos Credit,
- not to remove or hide it, or change its text or link;
- not to make it invisible, unreadable or unclickable with CSS, JavaScript, template edits, plug-ins or any other means;
- not to cover it with another element, or prevent the Software from showing it again.
5.2. The editable signature/copyright line in the theme's own footer is outside this Section; the User may put their own company name there.
6. Branding Removal Right
6.1. The User may buy the Branding Removal Right from Epsilos for a one-time fee. Epsilos assigns the right to the User's Licence and the Software stops showing the Epsilos Credit at its next licence check.
6.2. The Branding Removal Right is tied to the Domain it was bought for and is perpetual for that Domain. It cannot be moved to another domain, transferred, or carried over to another Licence.
6.3. If the User upgrades to a paid package, the Epsilos Credit is no longer shown, without needing the Branding Removal Right.
6.4. Purchase, payment and withdrawal are governed by the Epsilos Terms of Sale . Where the right qualifies as digital content whose performance begins when it is assigned to the Licence after payment, the right of withdrawal does not apply to the extent permitted by law.
7. Prohibited Use
The User agrees not to:
- reverse engineer, decompile or modify the Software or the licence file, or circumvent its licence or credit checks;
- sell, rent, redistribute, present as their own product, or sublicense the Software or the Free Edition;
- use the Licence outside the Domain it belongs to;
- use the Software for unlawful content or activities.
8. Breach and Termination
8.1. If the User breaches this Agreement, in particular Sections 5 and 7, Epsilos will notify the User by email and give 7 (seven) days to remedy the breach.
8.2. If the breach is not remedied in that time, Epsilos may suspend or terminate the Licence. When the Licence ends, the User's right to use the Free Edition also ends.
8.3. Epsilos's statutory rights to claim damages are reserved.
8.4. The User may end this Agreement at any time by removing the Software.
9. Warranty and Limitation of Liability
9.1. The Free Edition is provided "as is". Epsilos does not warrant that the Software will run uninterrupted or error-free, or that it is fit for a particular purpose. No support or service level is promised for the Free Edition.
9.2. A User on their own hosting is responsible for the site's backups, hosting and security. For a User on Epsilos Hosting, hosting and backups are provided by Epsilos under the terms of the purchased plan.
9.3. Except for intent, gross negligence and mandatory law, Epsilos's liability under this Agreement is limited to direct damages. Epsilos is not liable for indirect damages such as lost profit or lost data.
10. Personal Data
Data collected to issue and verify the Licence, such as name, contact details and Domain, is processed in line with the Epsilos Privacy Notice. The User is the data controller for personal data collected through their own site.
11. Changes
Epsilos may update this Agreement. The current text is published on the Epsilos website. Material changes are notified to the User by email. Continuing to use the Software after notice means accepting the updated text.
12. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction. The consumer arbitration committees and consumer courts provided for by law remain available to Users who are consumers.
13. Effective Date
This Agreement takes effect when the User accepts it electronically.
